Just as Ecclesia semper reformanda est, so the Roman Curia has always been in need of reform.  There is the obvious difficulty, however, that the New Testament provides no clear model of the ideal papal curia to which reforms might return.  So we enter into the complex relationship between Scripture and Tradition.  The article is divided into five periods: the first millennium until the beginning of the East-West schism in 1054; the Middle Ages until 1300, a period of notable growth in the papal curia; the late Middle Ages, beginning with the Avignon papacy and leading into the Renaissance papacy; the Counter-Reformation and its aftermath; finally, from the loss of the papal states in 1870 until today.  The brief Conclusion notes the remarkable nature of the Roman Curia, “the longest-running bureaucracy in world history”.

L’articolo si sofferma sulla questione della Curia romana in tre momenti fondamentali: il concilio Vaticano II (fase preparatoria e celebrazione), il pontificato di Paolo VI (specialmente Regimini Ecclesiae Universae del 1967) e il pontificato di Giovanni Paolo II (specialmente Pastor bonus del 1988). Le riforme post-conciliari della Curia hanno raccolto solo parzialmente le novità ecclesiologiche introdotte dal concilio e hanno agito su una struttura che è ancora quella datale da papa Sisto V nel 1588. La riforma montiniana, in particolare, appare un lascito del pontificato di Pio XII più che del concilio. La questione della Curia romana riparte, in un certo senso, da dove era rimasta al Vaticano II.

This brief essay considers the dilemma of practices and mindsets in the Roman Curia that have stood in contrast to directives of Vatican II. We consider the welcome return to the spirit of reform, why such remains necessary, the complex factors behind the divergence in conciliar and curial perspectives and explore some of the most significant areas where such has been witnessed. We offer the theory of cognitive dissonance as one fruitful way of interpreting such divergence between council and curia. Issues of ecclesial dialogue, participation and co-responsibility loom large in any such consideration. In particular, considerations of collegiality and the lay apostolate point towards a wider divergence in relation to the understanding and practice of magisterium, which in turn points to wider still and fundamental differences between Vatican II’s ecclesiological vision and that which has prevailed in Rome in recent times. A more humble and service oriented self-understanding of the curia, coupled with a revisiting of conciliar theory, attuned to a twenty-first century world, could offer great hope that the council might finally be implemented toward a flourishing future for the church.

Accompagnée d’une relance de la collégialité encore à définir, la réforme de la Curie romaine, telle qu’annoncée par le pape François, ne sera pas seulement managériale. Refusant  l’autoréférentialité et le cléricalisme, il prône une ecclésiologie de communion approfondissant les liens entre évêque et fidèles (plus de synodalité)  et, logiquement, entre les évêques d’une même région (plus de collégialité). Enracinant sa primauté dans son épiscopat romain, il la voit comme service de la communion des Églises au pluriel. Cessant d’être au-dessus des évêques, la Curie se trouverait devant leur rendre des comptes en même temps qu’au pape. Simultanément serait corrigée la conception universaliste actuelle du collège épiscopal, auquel on pourrait appartenir à titre personnel, et la passivité des Eglises locales privée de parole dans le choix de leurs pasteurs.

Soll das überwunden werden, was an der Römischen Kurie immer wieder kritisiert wird, dann braucht es Neuregelungen nach den Kriterien der Subsidiarität, Transparenz und Koordination. Neue Regelungen alleine genügen aber nicht. Sie müssen begleitet werden von der entsprechenden Haltung des Personals, die sich in Teamfähigkeit, Einfühlungsvermögen und Kommunikationsfähigkeiten ausdrückt. Dazu ist eine Professionalisierung und Entklerikalisierung wichtiger Funktionen und Positionen an der Kurie vorzunehmen sowie eine Gleichstellungsordnung und Frauenquote einzuführen. Die Römische Kurie als Vorreiterin und Muster für ein partnerschaftliches Miteinander von Frauen und Männer – das wäre auch eine wichtige Signalwirkung in die Ortskirchen und die Gesellschaft hinein!

This article argues that to convert the Roman Curia from a 17th-century court into a modern civil service and to incorporate the principles of collegiality and subsidiarity in church governance, it is essential to 1) stop making curial official bishops or cardinals; 2) separate legislative, executive, and judicial functions in the curia; 3) have curial offices supervised by committees of diocesan bishops; 4) strengthen the coordinating role of the sostituto; and 5) reorganize the curia with more emphasis on regions rather than functions. Reform will fail if curial officials continue to be ex officio bishops and cardinals.

A presente contribuição suscita a questão de até que ponto a reforma da Cúria, assunto a princípio de economia interna da Igreja Católica, tem significado para as relações ecumênicas. Refere-se a avanços registrados no diálogo e na cooperação ecumênica, bem como à perda do entusiasmo original com a causa do ecumenismo. Contudo, como as divergências entre as Igrejas se concentram hoje, em larga medida, em questões eclesiológicas, conclui que precisamente a reforma da Cúria poderá contribuir para uma maior aproximação, sintonia e cooperação entre diferentes confissões cristãs.

Es geht in diesem Aufsatz um die Erarbeitung spiritueller und pastorale Leitlinien für eine Reform der römischen Kurie, ausgehend vom Neuansatz des II. Vatikanischen Konzils, mit Rückgriff auf Entwicklungen gesellschaftlicher Verwaltungsstrukturen. Die funktionale Trennung von Legislative, Exekutive bzw. Administrative und Judikative wird bei der nachkonzilaren Kurienreform nicht beachtet, was als erste Leitlinie verlangt, diese strukturelle Sünde zu vermeiden und zugleich eine Orientierung an struktureller Entsprechung der Grundvollzüge der Kirche als Leiturgia, Martyria und Diakonia zu vollziehen. Als zweite Leitlinie sind werthaltige und moralische Momente in die Strukturen und Systemen einzubinden, die als verschiede Maxime aus den Texten des Konzil hervorgehen. Im Verfahren der Umsetzung ist ein offener Dialog zwischen Theologie, Kirchenrecht und Öffentlichkeit zu beachten und die gesammte Lage der Menscheit zu berücksichtigen damit die „Kirche der Armen“ sichtbar wird.
